Are there any ways in NYS to stop a vehicle reposession? Please read details below?

I was in the hospital since October 2007. I got out a week ago and I come to find out that my bank wants to repossess my car. I am late since October to now and they won%26#039;t work with me. The do not care that I was in the hospital and had no income during that time. I am now trying to get back on my feet, I do not have the past due money in full, but I do intend to pay ASAP. My credit rating is poor because of this and no one will grant me a loan (not even a refinance). I want to create a payment plan where I pay them X amount per week, but I highly doubt that since it has been this long that they will go for it. I was mailed a business card from a repo company called TCAR in NY with a case number..what can I do? I do not want to lose my car. I owe $1300 in past due payments. What are my options when I can%26#039;t pay that in full but am willing to pay in payments? Any other alternatives to save my vehicle? I currently am hiding my car in an undisclosed location because of the repo. ????? help

Parking it where they can not find it is not illegal, until they get a court order demanding you surrender the vehicle.



You can call the bank and ask to speak with the repossession / remarketing department. Explain to them that you want to do a payment plan to get current. This is the department that realizes that banks typically lose money on a repossession so they may be willing to work with you.



Unless the bank has a court order (and you would have to be served first), you do not have to give up your car, or it%26#039;s location.



Someone recommended credit counselor, but you need to make sure you get a good one (ie legit). There seem to be way more scams than legit companies.



The other option is Bankruptcy, a Chapter 13 would allow you a payment plan.

You have your car to deal with. That%26#039;s another, fiercer payment enforcement system.



You have alternative. None is pleasant. Every one involves, at the minimum, hassle.



If I were in your shoes, I%26#039;d go immediately to an ACCREDITED credit counselor (there are so many sharks in the credit counseling water today, I wouldn%26#039;t go to anyone not certified by aiccca.org or nfcc.org). They have experience in negotiating debt management plans, just for people like you.



Don%26#039;t fall for any get-out-of-debt-now schemes. Getting out of debt takes time and effort.
