Fraud question?

I had my debit card number stolen and used in NY. They spent over $2,000 at gamestops and other game places. They typed in the the number and used it as credit then signed %26quot;my%26quot; name to a receipt. I live in Georgia and made tranasactions at the time of the fruad in NY. My question is my bank will not reemberse $1800 of the money because they do not take care of business accounts with fruad(I signed the stupid thing when opening my account) They did return $300 of the %26quot;recovered funds%26quot; so can the business be held responsible since they allowed someone to type in the number and sign my name? Sorry for the long explanantion. And the bank can tell wither or not you swiped the card or typed the card.

Note, the Federal Trade Commission states that you would only be liable if you failed to report it for 60 days after the 1st bank statement showing the false charges.

You may want to check with an Attorney. The fact that the imposters were not in possession of the card, yet were allowed to use the number without ID, should put the burden of proof on those stores that did business with them. If there had been a fake, or stolen card, it would be different. The point remains, you were charged for purchases you did not make nor authorize; therefore you are not liable.

No, you can%26#039;t hold the businesses liable. Not their fault someone stole your card and signed your name. That%26#039;s part of the dangers of having a debit card with an institution that doesn%26#039;t hold you as no-fault when you%26#039;re defrauded.

Ooh...This is tricky. You might need to do some investigation into the laws in your state because the bank could be violating them, tricky people. Check out consumer affairs. Contact your state rep or the governor for assistance. They can point you in the right direction.

First, this is why I hate these fake piece of trash Visa/MC debit cards. If fraud is done, your account is drained until the money gets replaced.



Business accounts unfortunately do not enjoy the same protection as individual accounts. Still, this is not right and you need to push back against this bank. Tell them you%26#039;ll swear out fraud avadavits, talk the the bank manager, and if necessary start talking to his boss or some VP in the company.



Since you are in Georgia, you may also want to call the Clark Howard radio show. He%26#039;s a syndicated radio consumer advocates and he hates these debit cards. Sometimes he even gets his staff on the case.



Basically, you need to keep making as big of a stink as possible until they return your money.

It may be hard to get the business to repay, but if there is an investigation and they find the bast*%26amp;^, you might have a chance to recover.

no the business is not responsible they had no idea it wasn%26#039;t you who got the things most places where the cards are from carry the fraud insurance to protect them and us for stupid people who rip other people off everyday by fraud they need to start putting those in prison mire and it would cut down on a lot of this crap it is mostly stupid kids doing this that have nothing more to do than this
