my brother%26#039;s wife filed their taxes jointly while he was out of state...they were separating...she paid of her credit cards and banked the rest in her account. She also claimed his daughter after the childs mother already did. What is the process to get this taken care of?

Call the IRS she cannot claim someone that has already been claimed on another income tax.The SS is already in the data bank with the IRS.If she filed before the mother did then she could ,she will be banned from claiming anyone on her taxes for ten years and audited every year.



And unless she forged his signature there is no way she could have filed jointly.



She will have to pay back the IRS at 18 percent interest if he can prove she signed his name.

no both spouses has to sign return.someone must have forged his signature which everyone knows is illegal and can surely get u thrown in the slammer i would surely report it.i would file a amended return by snail mail and irs would send a letter asking his wife and the childs mother for proof of who has right to carry the dependant and it goes by who the child lived with for half of 2007 or all of 2007 and whoever wasn%26#039;t supposed to carry child will have to pay it back .
