Help, My Fiancee might go to jail for something he didnt do!?

My fiancee works for a video game store and 6 PS3 systems went missing. Long story short, they are blaiming him, and threatning him with jail if he doesnt %26#039;fess up%26#039; and do a payment plan to pay it back



He didnt take them, but they wont hear a word otherwise. Him and his manager were working that day, Tedd (fiancee) worked the morning, 8 hour shift, then his manager worked closing, 4 hours. The manager didnt report the loss, and the next day my fiancee opened the store, an noticed they were short 6. He says its possible the back door of the store ( which leads to a backhall to a few other stores in the mall) might have been left unlocked.



But they dont seem to care, or want to hear a word otherwise. They plan on holding him in jail till they can prove it. Help! He didnt take anything!



And now a coworker is spreading roumors about him , telling them my fiancee is in alot of debt , and it would pay it off if he was the one who stole it , so they ran a credit check

There would have to be proof before he is indicted. He needs a lawyer.

Lawyer him up NOW. Are the cops and DA charging him with the robbery or just the company claiming it was him. Without definite proof don%26#039;t worry and sue for deflamation of character/harassment.

If they had evidence against him they would not be asking him to fess up. If he does, that is evidence against him and can be used in a criminal prosecution.



Under no circumstance should he make any admissions of guilt. Furthermore, the store can only call the police and report the crime. They, the store, has no ability whatsoever to put him in jail. That is up to the police.



From your edit. The loss prevention is full of it. They cannot hold him for 10 days without charging him. Most states have limits of 48 to 72 hours and I know of none that has more than 72. They are trying to scare him into confessing.



He may want to think about quitting before they try to pressure him in to anything.

He gets a public defender, for they need real evidence that he took it. In any case, he needs to get a new job elsewhere

That%26#039;s ridiculios!! Get a lawyer they cannot take him to jail with out formally charging him and once they do that it%26#039;s all down hill for them. They can%26#039;t hold him without proof. Get a lawyer don%26#039;t let them push you around or intimidate you into confessing to something you didn%26#039;t do.

Most video stores have surveillance cameras you can ask his attorney to supena it as proof. In order for him to be convicted they have to have proof. It is also possible the manager took them :-) Check out pro bono. All attorneys have to offer free services to those who are financially in need. Many people do not know this. They can%26#039;t hold him in until they can prove it. They can only hold him if they already can prove it. Which means they better have some video of him taking it or some eyewitnesses. Since it sounds like they have neither, unless your fiancee isn%26#039;t telling you everything, it doesn%26#039;t sound like they have a case. If they go to press charges, get a lawyer and fight it. Did anyone consider maybe the manager took them? Its happened many times before in many companies.

Tell him to keep his mouth shut. They are trying to get him to confess to make it easier on them. They don%26#039;t have to read him his rights, because they are not cops, so anything he says will be used against him. This tactic works well on scared young people.



They can%26#039;t put him in jail. They will have to call the cops and file a criminal complaint and then the cops can come and arrest him if they desire. May happen, but the store can%26#039;t do it. They can%26#039;t necessarily hold him in jail either. Most jails will let you post bond or release you on your own recognizance and order you to appear in court.



So. No statements to anyone. Quit this job and move on.



I hope he didn%26#039;t do it, but he seems a very likely suspect, especially his whole %26quot;possible the back door might have been unlocked story.%26quot; That smells badly of a guilty mind in criminal court. If manager has been there a while, he will have more credibility than your man. Also...doesn%26#039;t help that your man is in debt (legitimately or not). It%26#039;s not necessarily spreading rumors if your fiance actually was in debt. Not like video-game store salary is high enough to move his debt to black quickly.

He is being blamed because someone who works there



would like to see him gone!! I would demand that managememt prove the case or I would bring a suit against



the company in a heart beat!!!! Stand up for your rights!!!!
